Terms & Conditions Chauffeured Ground Transportation

RIGHTS AND LIABILITIES:

1- All reservations require a Non - Refundable Deposit of either $200. or $250. Depending upon the vehicle and hour being Booked. The deposit shall be paid at the time that the reservation is made.
2- The full Balance for the trip must be paid One week prior to the reservation date, all payments are non-refundable.
3- All vehicles owned and/or operated by Frisco Limousine and affiliated are designated as non-smoking.
4- All vehicles are thoroughly cleaned and checked for damage prior to each engagement.
5- The client shall be responsible for any Cleaning or Repairs which may be required $200.00 due to any act of negligence or disregards by the client or by the client's requests.
6- Please note: Vomiting Cleaning fees are $250.00 and result in the Immediate termination of the run.
7- Any time passed the arranged drop-off time will be an additional charge in a 30-minute increment. An itinerary for the evening is attached.
8- Frisco Limousine cannot be held liable for items left in any vehicle. Please inspect the vehicle prior to dismissal.
9- Frisco Limousine reserves the right to immediately terminate the job, for all parties in attendance for the use of illegal substances and/or illegal activity by any quest in attendance.
There will be no refund for any monies to the client due to the negligent behavior of the passengers.
10- Frisco Limousine reserve the right to add an extra charge to Repair or Cleaning whenever such service is required as a result of customer use or abuse.
11- Failure to comply with the above rules will result in a $200.00 penalty added to your tab.
12- Customer is responsible for any damage to the vehicle caused by him/her, or his/her party.
13- Concerts/Events Parking Fees?*may be paid with Visa, MasterCard, ...prior to event start time.
14- Frisco Limousine is not liable for any circumstance, such as any kind of injury, weather conditions, road conditions, or vehicle breakdowns.
15- Frisco Limousine assumes no responsibility "We Cannot Guarantee an exact of limousine fleet type, age or color inside or outside.
16-Frisco Limousine assumes no responsibility for lost or damaged articles left in or nearby our vehicle

OUR TERMS OF USE POLICY

Frisco limousine will strictly enforce State and Federal Laws and will maintain a zero-tolerance compliance policy that no alcoholic beverages can be consumed or used by any person, not of legal drinking age. All US law enforcement agencies have absolute power to stop any motor vehicle from administrative searches. If contraband is aboard, even in negligible quantities without the chauffeur's knowledge, they can seize and forfeit this vehicle to a local government agency. All law enforcement agencies are aggressively enforcing this policy. Therefore no person will bring contraband aboard vehicles that are owned or operated by Frisco Limousine. Frisco Limousine will not be responsible for injuries that may occur while the vehicle is in motion including " entering and exiting the vehicle" or at a standstill. The purchaser on the front of this contract is responsible for his or her guests.

AT THE CHAUFFEUR'S DISCRETION, THE PURCHASER AGREES TO BE FULLY LIABLE FOR ALL CHARGES THAT MAY INCUR.

1- $ 300.00 per damaged seat, $ 300.00 per damaged carpet, $400.00 per damaged mirror
2- $ 200.00 minimum for extensive cleanup (spills, etc.)
3- $ 200.00 detailing and wax (due to sickness-exterior)
4- $ 200.00 shampoo and disinfecting (due to sickness interior)
5- $ 300.00 minimum for each burn hole, rip or tear to upholstery
6- $200.00 minimum to $2000.+ for each act of vandalism
7- Triple charge of above listed amounts for all removed/stolen items from the vehicle.
8- bad behavior and verbal abuse to the driver are not acceptable the driver has the right to cancel service.
9- Downtime subject to loss of revenue, per each hour lost as stated in the contract Frisco Limousine recommends that all and any personal valuables be removed from the vehicle when unattended. We will not be held responsible for any lost, stolen, or damaged articles and any articles handled by the driver while loading and unloading

NO LIABILITY. IN USING THIS WEBSITE, YOU SPECIFICALLY AGREE THAT YOU WILL NOT HOLD FRISCO LIMOUSINE LLC LIABLE TO YOU OR ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, OR OTHER CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF ANY USE BY YOU OF THIS WEBSITE (OR ANY OTHER LINKED WEBSITE), WHETHER THOSE DAMAGES ARE FINANCIAL IN NATURE OR RESULT FROM INJURY, LOST, INCOMPLETE OR INTERRUPTED DATA OR TRANSACTIONS. THIS LIMITATION ON OUR AND FRISCO LIMOUSINE LIABILITY MAY BE DIFFERENT IN CONNECTION WITH PARTICULAR PRODUCTS OR SERVICES THAT WE OFFER.

NO LIABILITY.IN USING OUR FLEET OR FARMING OUT WITH REFERENT COMPANY FLEET, YOU SPECIFICALLY AGREE THAT YOU WILL NOT HOLD US OR FRISCO LIMOUSINE LLC LIABILITY TO YOU OR ANY PARTY FOR ANY DIRECT, INDIRECT, INJURY INSIDE OUR FLEET OR EXITING OUT THE VEHICLE, OR OTHER CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF ANY USE BY YOU OR YOUR GUEST WHETHER THOSE DAMAGES ARE FINANCIAL IN NATURE OR RESULT FROM ANY KIND OF "INJURY" OCCURRED WHILE YOU USING OUR LIMOUSINE SERVICE WITH "NO EXCEPTIONNO LIABILITY. IN USING OUR FLEET OR FARMING OUT WITH REFERENT COMPANY FLEET, YOU SPECIFICALLY AGREE THAT YOU WILL NOT HOLD US OR FRISCO LIMOUSINE LLC LIABILITY TO YOU OR ANY PARTY FOR ANY DIRECT, INDIRECT, INJURY INSIDE OUR FLEET OR EXITING OUT THE VEHICLE, OR OTHER CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF ANY USE BY YOU OR YOUR GUEST WHETHER THOSE DAMAGES ARE FINANCIAL IN NATURE OR RESULT FROM ANY KIND OF "INJURY" OCCURRED WHILE YOU USING OUR LIMOUSINE SERVICE WITH "NO EXCEPTION.

Frisco Limousine reserves the right to terminate this or any other contract for noncompliance with the above requests, especially if renters do not follow chauffeurs requests in order to obey the rules in this contract. No smoking is allowed in our vehicles. Any deposits (cash, checks, or credit card authorization) will be non-refundable for any reason if any cancellation occurs from the renter's side. The open balance is due immediately at the beginning of the agreed job. The renter authorizes the immediate $250.00 deposit & the final payment, states that she/he is the authorized purchaser for this rental contract, the authorized cardholder for the given credit card, responsible and liable for payment of the total amount, per cash, credit card or money order.

No Smoking: All of our vehicles are No Smoking vehicles. The chauffeur at his sole discretion may terminate the trip with no refunds if smoking is occurring inside the vehicle. A minimum $300 cleanup fee will apply if smoking occurs in one of our vehicles. We will be happy to stop for as many smoke breaks as you need.

No Illegal Drugs: No illegal drugs to be carried or used in the vehicle at any time. The chauffeur at his sole discretion may terminate the trip with no refunds if illegal activity is occurring inside the vehicle. Police may also be notified.

No Underage Drinking: No underage drinking or underage possession of alcohol in the vehicle at any time. The chauffeur at his sole discretion may terminate the trip with no refunds if underage drinking is occurring inside the vehicle.

Lost Items: The renter assumes sole responsibility for any and all lost, stolen, or missing personal items during the term of the rental. Please be sure to gather all your belongings when you exit the vehicle at the end of the rental. Our phone number for lost and found is 214-854-6666.

Overtime: Be sure to reserve the vehicle for as long as you think you will need it. If you need to extend your rental we will be happy to do so as long as there is still availability, however, availability of additional hours at the last minute beyond those reserved can not be guaranteed as someone else may have already booked the vehicle right after your scheduled rental time is complete.

Emergency Vehicle Substitution: In the unlikely event that a last-minute mechanical breakdown or accident puts a vehicle temporarily out of service Frisco Limousine reserves the right to substitute an alternate vehicle (or vehicles) from our fleet or from our affiliates fleet. Alternate vehicles (or vehicles) may possibly be different in size or description than the originally booked vehicle depending on availability. No refunds or discounts will be given if an alternate vehicle is provided at the agreed-upon pickup time.

Frisco Limousine cannot guarantee fleet type year or age or color or the availability of overtime. It is of particular importance that the purchaser makes allowances for anticipated delays and adheres to the agreed time schedule. In the event that the purchaser wants to change the time of the itinerary, they may do so, only if Frisco Limousine can accommodate other clients that booked with Frisco Limousine prior to or after the said time. The purchaser further agrees to pay additional charges incurred such as overtime, tolls, parking, etc. Overtime for airport jobs is charged in 1-hour increments, extra stops are charged $ 25.00 - Lincoln; $ 30.00 - SUV. $50.00 Stretch Limousine.

If a customer fails to show (No Show) at the designated pick-up location and does not inform the office and/or driver, the full amount of contracted time will be charged. The purchaser authorizes Frisco Limousine to charge any additional charges after they have rendered services to the purchaser's credit card as a supplemental charge. A 20% gratuity will be added to your total charge as well as a 9% service surcharge. If cash payment is selected, the payment is due at the beginning of the rental time. The customer agrees to have Frisco Limousine get authorization for the above credit card and the amount, for the event stated above.

This Agreement shall be governed by and construed in accordance with the laws of the state of Texas and the Federal Arbitration Act, without giving effect to any principles of conflicts of laws, and you hereby consent to the exclusive jurisdiction of the state and federal courts sitting in Dallas County, Texas.

You and Frisco Limousine, LLC. Agree that any and all disputes and claims relating in any way to this Agreement (including the arbitration of any claim or dispute and the enforce-ability of this paragraph), with the exception set forth in the next paragraph, shall be submitted to and resolved by means of confidential arbitration conducted in the state of Texas, Dallas County. If you and Frisco Limousine, LLC. Cannot agree on arbitrators, the Presiding Judge of the Dallas County Superior Court shall appoint them. The arbitration shall be conducted under the then-prevailing Commercial Arbitration Rules of the American Arbitration Association (AAA). You and Frisco Limousine, LLC. May litigate in court only to compel arbitration under this Agreement or to confirm, modify, vacate or enter judgment on the award rendered by the arbitrators. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

However, to the extent you have in any manner violated or threatened to violate Frisco Limousine, LLC. Intellectual property rights, Frisco Limousine, LLC. May seek injunctive or other appropriate relief in any state or federal court in the state of Texas, and you consent to exclusive jurisdiction and venue in such courts.

Your signature below demonstrates full understanding and agreement with the policy as set forth above.

At the time these collations are agreed upon and signed, the contract for hire will begin.
